Acceptance and eligibility
By downloading, installing or using the Trefine application, or by using this website, you agree to these Terms of Service. If you do not agree to them, do not use the application. You must be 18 or over to use Trefine: it is built for working professionals, and its Culture feature draws on general reference sources that are not age-rated and that we do not curate in advance. If you are using Trefine in the course of your employment, you confirm that you are authorised to accept these terms in that context.
The service
Trefine is a daily practice application for professionals working across cultures, comprising three short practices covering fluency, culture and habits. It operates without an account and processes your voice on your device. Trefine is currently offered free of charge. We may add, change or withdraw features, and we may discontinue the application, at our discretion.
Your content
Your recordings, transcripts, goals and reflections are yours. They are stored on your device and are not uploaded to us. We claim no licence over them, and we hold no copy to return, disclose or retain. Deleting the application deletes them. How they are handled is described in our Privacy Policy.
Artificial intelligence content
Trefine’s practice prompts, coaching feedback and culture cards are written by an artificial intelligence model running on your device, and such output can be wrong. Coaching may misjudge your speech: treat it as practice, not an authoritative assessment. Culture content may be culturally or historically inaccurate: use it as a conversation prompt, not an authoritative source. Trefine does not provide professional, medical, legal or career advice, and its coaching feedback is neither a qualification nor an assessment of professional competence. You are responsible for any decision you take in reliance on the application’s output.
Culture content and licensing
Culture cards are adapted from text published on Wikipedia and Wikivoyage under the Creative Commons Attribution-ShareAlike 4.0 International licence (CC BY-SA 4.0). Each card links the source from which it was adapted, and the adaptation is performed by the model on your device. Card text is accordingly available to you under CC BY-SA 4.0. That licence extends to card text only.
Intellectual property
Except for the card text described in clause 5 and your own content described in clause 3, the application, this website, their software, design, text and branding are owned by us or our licensors and are protected by intellectual property law. You may not copy, modify, distribute, sell, lease, reverse engineer or attempt to derive the source code of the application, except to the extent that applicable law expressly permits it despite this restriction.
Acceptable use
Use Trefine for personal practice. You must not use it unlawfully; interfere with or disrupt the application or the third-party services it relies on; attempt to gain unauthorised access to any system; present its output as a professional, medical or legal assessment; or use it in any way that infringes the rights of others.
Feedback
If you send us a suggestion, a bug report, or any other comment about Trefine, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose, including improving the application, without obligation or payment to you. Please do not include confidential information or personal details in feedback; we do not need them and we do not want to hold them.
Third-party links and services
Trefine and this website link to material we do not control, including the Wikipedia and Wikivoyage pages cited as card sources, and the application relies on services operated by others, including the model host and Wikimedia Foundation. We do not endorse and are not responsible for the content, accuracy, availability, or practices of those sites and services, and your use of them is governed by their own terms.
Availability
Trefine is provided on an as-available basis. We do not guarantee that it will be uninterrupted or error-free. The application depends on third-party services, including the model host and Wikimedia Foundation, whose availability is outside our control, and some features will not function without a network connection.
Disclaimers
To the fullest extent permitted by applicable law, Trefine is provided as is and as available, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, in which case this clause applies to the fullest extent those laws permit.
Limitation of liability
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or exemplary loss, or for any loss of data, profits, revenue, goodwill or business opportunity, arising out of or in connection with your use of Trefine, including any decision made in reliance on artificial intelligence output. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
Indemnity
To the extent permitted by applicable law, you agree to indemnify us against any claim, liability, loss or reasonable cost we incur arising from your use of Trefine in breach of these terms, from your unlawful use of the application, or from your infringement of another person’s rights. This clause does not apply to any claim arising from our own breach of these terms or our own negligence, and it does not limit rights you have under mandatory consumer protection law.
Ending your use
You may stop using Trefine at any time by uninstalling it, which removes the practice data stored on your device. We may suspend or discontinue the application, in whole or in part, at our discretion. Clauses 6, 8, 11, 12, 13, 15 and 17 survive any termination of your use.
Governing law
These terms are governed by the law applicable to the operator of the service and to its relationship with you, subject in every case to the mandatory consumer protection and data protection rights available to you in your country of residence, which these terms do not displace. Questions or disputes should be raised with us first at support@trefine.co.
Distribution through Google Play
Trefine is distributed through Google Play, and your download and installation are also governed by Google Play’s own terms. These terms are between you and us, not between you and Google. Google is not responsible for the application or its content, and provides no support or warranty for it. Google is a third-party beneficiary of these terms as they relate to the Android application, and may enforce them against you as such.
General
If any provision of these terms is held to be invalid or unenforceable, it applies to the greatest extent permitted and the remaining provisions continue in full force. Our not enforcing a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us about Trefine and replace any earlier understanding. You may not transfer or assign your rights under these terms. We may transfer ours to a successor in connection with a sale or reorganisation of the business, provided your rights under these terms are not reduced.
Changes to these terms
We may update these terms as the application changes. The effective date above records when this version took effect. Where a change is material, we will reflect it here before it takes effect. Continuing to use Trefine after a change takes effect constitutes acceptance of the updated terms.
